Terms of Service for Pinchly

Welcome to Pinchly. By using the Pinchly: Intermittent Fasting mobile application (the "App"), you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the App.

1. Description of Service

Pinchly is an intermittent fasting coach that builds a personalized fasting plan from your schedule and goals, provides hour-by-hour fasting guidance, craving support, and reminders, and offers an optional AI selfie feature ("Pinch Score") that estimates facial-composition trends over time. The App does not require an account or login.

2. Health and Wellness Disclaimer

Pinchly is a wellness and habit-building tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The Pinch Score is a directional, motivational indicator only and is not a body measurement or medical assessment.

Intermittent fasting is not appropriate for everyone. Do not rely on the App as a substitute for professional medical advice. Consult a qualified healthcare provider before starting any fasting plan, especially if you are pregnant or breastfeeding, have a history of disordered eating, have diabetes or another medical condition, take medication, or are under 18. Stop fasting and seek medical attention if you feel unwell. You use the App at your own risk.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement.

4. Subscriptions and Payments

- Premium features are offered through auto-renewing subscriptions purchased via the Apple App Store.
- Payment is charged to your Apple Account at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple Account settings after purchase.
- Refunds are handled by Apple in accordance with App Store policies and applicable law.
- Any free trial automatically converts to a paid subscription unless cancelled before the trial ends.

5. Acceptable Use

By using the App, you agree to:
- Use the App only for lawful, personal, non-commercial purposes
- Provide accurate information so the App can personalize your plan
- Not attempt to reverse engineer, hack, disrupt, or misuse the App
- Only submit a selfie of yourself, and not upload images of other people without their permission, or any unlawful or harmful content

6. Your Content

You retain ownership of the selfie you provide. You grant us a limited license to process that image solely to generate your Pinch Score, as described in our Privacy Policy. We do not retain your selfie after processing.

7. Intellectual Property

The App, including its content, design, and software, is owned by us and our licensors and is protected by applicable laws. You may not copy, resell, redistribute, or commercially exploit the App.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted or error-free, that your plan or Pinch Score will meet your expectations, or that any particular result will be achieved.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any health-related outcomes, arising from your use of the App.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

11. Termination

We reserve the right to suspend or terminate access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or to us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last Updated" date above. Your continued use of the App after changes constitutes acceptance of the new Terms.
